Overview
These Terms and Conditions ("Terms") govern your use of the elevate software ("Software"). By downloading, installing, or using the Software, you agree to these Terms.
These Terms are between you and Brett Scheetz, an individual based in the Australian Capital Territory, Australia ("we", "us"). elevate is the product name only. It is not a company name.
elevate is currently offered as a free beta until the current trial period ends. We may update these Terms if the beta changes or ends.
1. License Grant
We grant you a non-exclusive, non-transferable, revocable license to install and use the Software for your own evaluation and project work during the current beta / trial period.
You may:
- Install and use elevate on as many devices as you like while beta access is available
- Create and export designs and files for your own projects
You may not:
- Resell, sublicense, or distribute the Software
- Reverse engineer or modify the Software for redistribution, except to the extent permitted by applicable law
- Share access credentials or activation keys publicly
2. Ownership
The Software and all related intellectual property remain the property of Brett Scheetz. All designs and project files you create using the Software belong to you.
3. Beta Access
elevate is currently provided as a beta and may be incomplete, unstable, or change substantially without notice.
Features, file formats, device limits, and access rules may change during the beta / trial period.
We may modify, suspend, or end beta access at any time. If we do, continued use may require updated Terms.
4. Updates
While beta access is active, we may provide bug fixes, improvements, experimental features, or other changes.
We make no guarantee that future versions will remain compatible with older files (though every effort is made to do so).
5. Acceptable Use
You agree not to use elevate for:
- Illegal activities
- Malware creation
- Copyright infringement
- Harassment or abusive conduct
6. Disclaimer
elevate is provided as a beta and “as is” without warranties of any kind.
We do not guarantee:
- Fitness for a particular purpose
- Error-free operation
- That results meet professional regulatory standards (e.g. building codes)
You remain responsible for verifying all outputs.
This section is subject to any non-excludable warranties or guarantees under applicable law.
7. Limitation of Liability
To the maximum extent permitted by law:
- We are not liable for indirect or consequential damages
You are responsible for backing up your work and verifying all outputs before relying on them.
Nothing in these Terms excludes liability that cannot be excluded by law (for example, liability for fraud or wilful misconduct, or other non-excludable rights under Australian Consumer Law and similar laws).
8. Termination
We may suspend or terminate your license if you materially breach these Terms and do not cure the breach within a reasonable time after notice (where reasonably practicable). Upon termination, you must stop using the Software and delete all copies.
9. Privacy
The Software uses limited data for beta access, trial management, and fraud prevention, including:
- License key or activation data, where applicable
- Device identifier (to help enforce device limits and detect abuse)
- Optional information you provide if you contact support

10. Governing Law
These Terms are governed by the laws of the Australian Capital Territory, Australia. If you are a consumer, you may also have mandatory rights under the laws of your country or state.
11. Changes to Terms
We may update these Terms occasionally. If changes are material, we will take reasonable steps to provide notice. Changes apply from the "Last updated" date above. Continued use of the Software after changes take effect constitutes acceptance. If you do not agree, stop using the Software.
